Terms of Service

These Terms & Conditions govern the sale of fine art by Shakya Gallery ("we", "us") and the Client ("you"). By acquiring an artwork, you agree to these terms.

1. Guarantee of Authenticity

We guarantee the authenticity of every artwork we curate. Each piece is an original creation hand-signed by the stated artist, sourced directly from our partner artists and studios in Kathmandu.

In the unlikely event that an artwork is proven to be inauthentic by a recognized authority within five (5) years of purchase, we will refund the full purchase price upon return of the work in its original condition.

2. Payment & Transfer of Title

• Prices are listed in USD unless otherwise stated.
• We accept payment via Bank Wire Transfer (SWIFT), or local digital wallets and Cash on Delivery (Nepalese clients).
• Title of Ownership passes to the buyer only upon our receipt of full payment in cleared funds.
• We reserve the right to cancel any order if payment is not received within 7 days of invoicing.

3. Shipping & Import Duties

International Shipments: We provide professional crating and insured shipping via registered couriers (DHL/FedEx/Cargo). Most orders are dispatched within 7-14 business days of payment verification.

4. Refunds, Exchanges & Cancellations

We want you to acquire art with complete confidence:

• Pre-Shipment Inspection: Before crating and dispatch, we provide detailed photographs and video of your artwork. You may cancel your order for a 100% full refund if unsatisfied prior to dispatch.
• Cancellations: Requests for cancellation must be submitted within 48 hours of order placement or prior to courier dispatch for a full refund.
• Transit Damage: All shipments are 100% insured. If an artwork arrives damaged, notify us within 7 days with photographs of the packaging and canvas to receive a full refund or exchange.
• Exchanges: Once safely delivered, artworks may be exchanged for alternative pieces or gallery credit within 7 days of delivery, provided the piece remains in immaculate condition.
• For discretionary exchanges, insured return shipping and destination import duties are coordinated by the collector.

5. Governing Law

These terms are governed by the laws of Nepal. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal.
